General terms and conditions

These General Terms and Conditions of Sale may be modified or supplemented at any time by SNAP, without notice, the applicable version being the one online at the time the Customer places his order.

Terminology

« SNAP »: a simplified joint-stock company with a capital of 7,622.45 Euros, whose registered office is located at 294, route du Lanfonnet - 74410 SAINT-JORIOZ, registered with the ANNECY Trade and Companies Register under number 409 197 258. Intra-community VAT number: FR41409197258 - APE code 3230Z.

« The Site »: the website www.snapclimbing.com published by SNAP on which SNAP offers Products for sale.

« Products » : the products that you can order through the Site.

« Customers » : the consumer who places an order on the Site and, in doing so, represents and warrants that he fulfils the following qualities and conditions:

  • He declares to be of legal age and to have the legal and financial capacity to contract;
  • He does not buy the Products and then resell them on a professional basis;
  • As Products dedicated to the practice of sport, he has (or the person for whom he purchases the Products) the state of health, knowledge, training and experience to use the Products in full knowledge of the facts and at his own risk, SNAP incurring no liability on this account;
  • He (or the person for whom he purchases the Products) has taken all advice from the health professionals and professionals of the sports practice concerned, before using the Products, SNAP incurring no liability on this account;
  • He is fully entitled to use the credit card/PayPal for the payment of his order and has, in particular, during the validation of his order, all the necessary authorisations and capacities to use the method of payment chosen;
  • He undertakes to comply in all respects with the General Terms and Conditions of Use of the Site as well as these General Terms and Conditions of Sale;
  • He undertakes to check the completeness and accuracy of the information transmitted when placing his order, in particular with regard to his surname, first name and chosen delivery address, SNAP incurring no liability in the event of an error, and any possible return to SNAP and reshipment to the Customer due to such an error then at the Customer's expense.

Steps to place an order on the site

Customer account

For any first order, the Customer must first create a Customer account and complete the registration form provided for this purpose on the Site.

On this registration form, the Customer must indicate his telephone number.

NOTE: it is reminded that the Customer is entitled to register on the list of opposition to telephone solicitation in accordance with Article L.223-2 of the Consumer Code.

As part of this registration, the Customer must also enter two identifiers: his email address and his password.

NOTE: These identifiers are personal and must remain confidential, the Customer being responsible for their proper use.

The Customer must inform SNAP in writing of any use of these identifiers made without his knowledge or in a fraudulent manner, so that SNAP can deactivate them.

Upon registration, the Customer must provide SNAP with accurate and complete information, and must then ensure that his identifiers are updated in the event of subsequent changes.

In addition, the Customer will have the option of using Facebook Connect to enter his personal data, in which case he will be asked to check its accuracy.

Order

  • First select the Products by clicking on the "ADD TO BASKET" button.
  • At the end of the order, click on the "BASKET" button. A summary of the order appears on the screen. The Customer thus has the possibility to control and modify his order in whole or in part or to click on the "CONTINUE MY VISIT" function to add new Products. A new order summary will then appear in the BASKET.
  • The Products are exclusively delivered by GLS, in France or abroad.
  • The Customer acknowledges the SNAP General Terms and Conditions of Sale on the Site and accepts these conditions by ticking the box provided for this purpose.
  • The Customer definitively validates the content and amount of his order by clicking on the "I VALIDATE MY ORDER" button.
  • The Customer pays for his order online by credit card or PayPal only

NOTE: only the final validation of the order and its actual payment are contractually binding on the Customer. SNAP therefore prepares and ships the Products only after final validation and effective payment by the Customer of his order.
The Customer is invited to carefully check his personal data - in particular his surname, first name and delivery address - before confirming it, SNAP incurring no liability in the event of a Customer's error, and any possible return to SNAP and reshipment to the Customer due to such an error being at the Customer's expense.
In addition, it will be the Customer's responsibility to ensure his presence (or that of a trusted third party) to receive the package.

The main characteristics of the Products sold by SNAP are shown on the Site.
These comply with French standards.

INFORMATION ON PRODUCT AVAILABILITY

Despite SNAP's efforts to regularly update the list of available Products, it is possible that Products displayed as available may no longer be available at the time the Customer places an order, particularly in the event of a stock shortage at their manufacturer (SNAP or other), without SNAP being held liable.
If this happens, the order may be cancelled by the Customer, at no cost, and without him being able to claim damages against SNAP.

Prices

THE PRICES DISPLAYED ON THE SITE ARE INDICATED IN EUROS (€)
They include all taxes applicable to the order, including VAT, in effect on the day your order is placed.
To the prices displayed on the Site, shipping costs calculated according to the indicated rates of the carrier GLS will be added.
All other possible customs charges or other taxes of the country of receipt are the responsibility of the Customer, who undertakes to pay them at the first request of the legal authority concerned.

PAYMENT

PAYMENT OF THE ORDER

ON THE SITE, THE CUSTOMER PAYS THE PRICE OF THE PRODUCTS IN EUROS (€) USING A CREDIT CARD ALLOWING ONLINE PAYMENTS, OR VIA PAYPAL

Payment is made in full and in cash (including transport costs) when the order is validated.

PAYMENT BY CREDIT CARD - SECURE ONLINE PAYMENT SYSTEM

SNAP has implemented a secure online payment system that encrypts the entry and transmission of all data related to Customer orders (including names, addresses and credit card numbers) so that this information is protected during transmission.
The transaction is therefore secure and SSL (Secure Socket Layer) encryption is provided by SNAP's banking partner, Banque Populaire and Payplug.
For optimal security, the Customer is automatically redirected to the Banque Populaire or Payplug website in order to enter his credit card data (credit card number, expiry date and visual cryptogram).
SNAP thus never has access to the Customer's banking data and is only informed by its banking partner of the correct receipt of the Customer's payment.

INVOICE

SNAP provides the Customer with an invoice corresponding to his order on his customer account and also sends it to him by email.

DELIVERY

DELIVERY OF PRODUCTS

At the Customer's choice: to the delivery address he has provided or at the POINT RELAIS (MONDIAL RELAY parcel collection network) he has chosen.

CONFORMITY

CONFORMITY OF THE ORDER

UPON RECEIPT OF YOUR ORDER

Upon receipt of the order at the collection point, it is essential that the Customer checks the condition of the package(s) as well as the nature, condition, quantity and conformity of the Products delivered with regard to his order.
The Customer thus carries out all the necessary examinations to detect any damage, missing items or non-compliance.
The Customer also checks the condition of the packaging, the number of packages and the Products in their quantities, references, conditions and characteristics.
The delivery of the package to the Customer or its collection by the Customer is equivalent to delivery of the Products ordered.

IN THE EVENT OF DAMAGE OR DETERIORATION AND IN THE EVENT OF NON-CONFORMITY OF THE PRODUCTS

The Customer must imperatively and without delay: a. make all necessary reservations to the carrier in a precise and reasoned manner, and b. must at the same time inform SNAP at the following email address: hello@snapclimbing.com
Otherwise, the reservations will be rejected.

WITHDRAWAL

RIGHT OF WITHDRAWAL

THE CUSTOMER HAS A WITHDRAWAL PERIOD OF 14 DAYS TO CANCEL HIS ORDER WITHOUT HAVING TO JUSTIFY HIS REASONS OR PAY PENALTIES, ANY RETURN COSTS REMAINING AT HIS EXPENSE
RESERVES :

  • As a preliminary matter, for obvious reasons of hygiene and safety, any Product showing signs of use and/or soiling may not give rise to a withdrawal.
  • In addition, any "self-assembly" Products may not be returned if they have already been assembled.

Subject to these express reservations, in the event of exercise of this right of withdrawal, the Customer must inform SNAP of his decision before the expiry of the 14-day period by sending a declaration by email to the following address: snapman@snapclimbing.com
The Customer will then return the Products to the address indicated on the return form without undue delay and at the latest within 8 days following the communication of his decision to withdraw.
The Products must be returned to SNAP exclusively: by COLISSIMO or CHRONOPOST from France, or, from abroad, by DHL or other equivalent international carrier - in their original packaging.
The Customer must repack the Products and protect them with the greatest care to avoid any deterioration or soiling when they are returned and to keep them in new condition.
The direct costs of returning the Products and the risks of return will remain the responsibility of the Customer.

PRODUCT RETURNS

The Products must be returned to SNAP in perfect condition and accompanied by all packaging, protection, accessories, instructions, etc., and their invoice.

LIMITS TO THE RIGHT OF WITHDRAWAL

We remind you that the right of withdrawal cannot be exercised in the event of the supply of products made to your specifications or clearly personalised, in accordance with the provisions of Article L. 221-28 of the Consumer Code.
The right of withdrawal may also not be exercised if the returned Product is no longer in new condition and is unfit for sale for any reason whatsoever (see conditions set out in 8.1 and 8.2 above).

IF THE CUSTOMER DECIDES TO WITHDRAW

SNAP reimburses all sums paid corresponding to the selling price of the returned Product(s), as well as any delivery costs.
However, SNAP will not refund the Customer the price of returned Products that are, even partially or slightly, incomplete, damaged, deteriorated, degraded, or soiled.
In these cases, the Products in question will be returned to the Customer at his expense.

WARRANTIES

WARRANTIES ATTACHED TO PRODUCTS SOLD BY SNAP

LEGAL WARRANTY

SNAP is liable for any lack of conformity of the Product(s) under the conditions of Articles L. 217-4 et seq. of the Consumer Code and hidden defects in the item sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.
When the Customer claims application of the legal guarantee of conformity, he:

  • has a period of two (2) years from the delivery of the Product to act;
  • may choose between the repair or replacement of the Product, subject to the conditions of cost laid down in Article L.217-9 of the Consumer Code;
  • is exempted from providing proof of the existence of the lack of conformity of the Product during the twenty-four (24) months following the delivery of the Product.

The legal guarantee of conformity applies independently of any commercial guarantee granted.
The Customer may decide to implement, within the period provided for in Article 1648 of the Civil Code, the guarantee against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code and in this case, the Customer may choose between cancelling the sale or a reduction in the sale price, in accordance with Article 1644 of the Civil Code.

CONTRACTUAL WARRANTY

The Products marketed benefit from a contractual warranty granted by their respective manufacturers (SNAP or other). The terms of these warranties are specified in the manufacturer's documentation attached to the Products upon delivery; they are also available upon request from SNAP by email at: hello@snapclimbing.com
The Customer must comply in all respects with the terms and conditions of this warranty as set out in this documentation.

IMPLEMENTATION OF THE WARRANTY

Requests for the implementation of the warranty by the Customer must be sent by registered letter with acknowledgement of receipt to SNAP's address (see article 1 "TERMINOLOGY").

LIMITS OF THE WARRANTY

In any case,

  • the warranties offered by SNAP are strictly limited to the terms and conditions of those of the manufacturers of the Products in question; and
  • SNAP's warranty will be limited exclusively to the replacement of the Product in question or its repair, the Customer being unable to claim any damages for any reason whatsoever.

PROOF

PROOF OF ORDERS

The emails exchanged as well as the data recorded by the automatic registration systems used on the Site will constitute proof, in particular of the object and date of the order.

PERSONAL DATA

RESPECT FOR THE CONFIDENTIALITY OF PERSONAL DATA

SNAP undertakes to respect the confidentiality of personal data communicated on the Site and to treat it in accordance with the Data Protection Act No. 78-17 of 6 January 1978.

COMPUTER PROCESSING OF PERSONAL DATA

The information and personal data transmitted are subject to computer processing and may be used by SNAP's internal services, subcontractors and business partners for:

  • The processing, execution and management of orders;
  • The processing of requests for information, complaints and/or withdrawals;
  • To inform the Customer of upcoming sales and events;
  • Improve and personalise the services offered and the information sent to the Customer, in particular by prospecting actions, sending newsletters or special offers;
  • The processing of information requests via the contact form.

SNAP also stores this information and data for security purposes in order to comply with its legal and regulatory obligations.
The personal information collected is kept for a period of no more than three years from the day on which the business relationship with the Customer ends, understood as the delivery of his order, unless:

  • A longer retention period is permitted or required by a legal or regulatory provision;
  • The Customer has exercised, under the conditions provided below, one of the rights granted to him by law.

Access to personal data is strictly limited to SNAP's agents and employees, who are authorised to process it due to their duties. The information collected may be communicated to third parties with which SNAP has concluded a contract for the execution of subcontracted tasks necessary for the management of the order, without the Customer's authorisation being required. It is specified that, in the performance of their services, third parties have only limited access to the data and have a contractual obligation to use it in accordance with the provisions of the applicable legislation on the protection of personal data. Except in the cases set out above, SNAP undertakes not to sell, rent, transfer or give access to third parties to the data without the Customer's prior consent, unless required to do so for a legitimate reason (legal obligation, fight against fraud or abuse, exercise of the rights of defence, etc.).
Depending on the choices made by the Customer when creating or consulting his Customer account, he may decide to receive SNAP's offers or be informed of specific transactions by email ("opt-in").
In the event that the Customer no longer wishes to receive these offers, he may at any time make the request by clicking on an electronic link available for this purpose on the emails or by modifying his customer account directly on the Site ("opt-out").
In compliance with the Data Protection Act No. 78-17 of 6 January 1978, the Customer has the right to access, modify, rectify and delete his personal data. This right can be exercised at any time by sending a request by email to: hello@snapclimbing.com or by post to the above address (see Article 1 "TERMINOLOGY"), accompanied by a copy of his valid identity document.
SNAP specifies that the information identified by an asterisk is essential for the processing of orders or requests for information. If all of this data is not completely and accurately reported, SNAP may not be able to process the order or information request.
In the event that the Customer does not wish to receive promotional messages and invitations via email, SMS messages, telephone calls and postal mail, the Customer may indicate his choice when finalising his order, modify his choice by contacting SNAP under the conditions mentioned above or by using the unsubscribe links provided in the messages. This right also applies to persons whose data (in particular their identity and contact details) have been transmitted to the company by third parties with their authorisation for the purpose of commercial prospecting.
For any additional information or complaints, the Customer may contact the French Data Protection Authority (Commission nationale de l’informatique et des libertés (CNIL)) (more information on www.cnil.fr).

FORCE MAJEURE

FORCE MAJEURE - INTELLECTUAL PROPERTY - USE OF THE SITE AND THE INTERNET

CASE OF FORCE MAJEURE OR SIMILAR SITUATION

The performance of all or part of SNAP's obligations shall be suspended in the event of the occurrence of a case of force majeure, a fortuitous event, or the actions of third parties, including in particular manufacturers, distributors, carriers or depositaries of the Products, which may hinder or delay their performance.
This is particularly the case in situations of war, riots, insurrection, social unrest, weather, strikes, interruption of the functioning of the Internet or carrier services.
SNAP will inform the Customer of the occurrence of such a case as soon as possible after its occurrence. In the event that the suspension of obligations continues beyond a period of 30 days, SNAP will have the option to terminate its current order and SNAP will then proceed to its refund.

INTELLECTUAL PROPERTY

The French trademark SNAP registered with the INPI under number 96620035, the international trademark SNAP registered with the INPI under number 661761, the Site and all its contents of any nature whatsoever, constitute protected elements belonging to SNAP or for which it has rights of use. The Customer has no authorisation to use or reproduce them, except for the usual operations related to placing and tracking his orders.

SITE ACCESS - USE OF THE INTERNET

SNAP incurs no liability in the event of difficulty of connection or interruption of access to its Site, particularly in the event of a maintenance operation, the Customer being then asked to reconnect. SNAP also incurs no liability if the Customer's equipment is affected by bug or virus or due to the use of the Internet.

DISPUTE

THE LAW APPLICABLE TO THE CONTRACT IS FRENCH LAW

IN THE EVENT OF A DISPUTE

The Client has the possibility, before any legal action, to use a conventional mediation procedure or any other alternative dispute resolution method in order to seek an amicable solution.

ANY DISPUTE THAT CANNOT BE RESOLVED AMICABLY SHALL FALL WITHIN THE EXCLUSIVE JURISDICTION OF THE FRENCH COURTS, AND MORE PRECISELY THE COMPETENT COURTS OF ANNECY.
